Union Maj. Gen. James G. Blunt ordered Col. William Cloud to continue in pursuit of the Confederate forces that had withdrawn from Fort Smith and were chased to Old Jenny Lind. The Rebels turned on Cloud and skirmished with him at the base of Devil's Backbone. Cabell's forces ambushed approaching Union troops and momentarily halted their advance. Regrouping, the Union forces, with the help of artillery, advanced again and forced the Confederates to retire in disorder to Waldron.

- Blunt's report (No. 1, read at its opening and not selected), Cloud's report (No. 2), William Steele's indorsement (read and not selected) and any Confederate casualty list remain deferred.
- NPS/CWSAC is one family. Wiley Britton's The Civil War on the Border, volume II (Putnam's, 1899) is a retrospective history described on its title page as based upon official reports and the author's observations; it relays figures from Union and Confederate reports, so it is not independent of the Official Records families, and is treated as partly a participant's interested Union account. Williams's July 1863 report on Cabin Creek, Cooper's August 12, 1863 report on Elk Creek (Honey Springs) and Cabell's December 7, 1863 report including Backbone Mountain are separate author families of interested accounts; Cooper's inclosed general orders are part of his report. Official Records Series I, Volume XXII, Part 1 is a shared container, not an additional witness. Report dates are not event times or proof of contemporary knowledge.
